According to Section 409(h)(1)(C) of the Federal Food, Drug, and Cosmetic Act, food contact substance notifications (FCNs) are effective only for the listed manufacturer and its customers. Other manufacturers must submit their own FCN for the same food contact substance and intended use.
Food Contact Substance: Phosphorous acid, triphenyl ester, polymer with α-hydro-ω-hydroxypoly[oxy(methyl-1,2- ethanediyl)], C10-16 alkyl esters (CAS Reg. No. 1227937-46-3). REPLACES FCN 1429

Intended Use: As a thermal stabilizer in single- and repeated-use food contact articles, except for use in contact with infant formula and breast milk (see Limitations/Specifications)
Limitations/Specifications: For use at levels not to exceed 0.20 percent by weight in linear low density polyethylene (LLDPE) films, and high density polyethylene (HDPE) articles in contact with all types of food under Conditions of Use A through H. The FCS may be used in conjunction with triisopropanolamine (CAS Reg. No. 122-20-3) at a maximum use level of 1.5 percent by weight of the FCS. The FCS is not for use in contact with infant formula and breast milk. Such uses were not included as part of the intended use of the substance in the FCN.
