According to Section 409(h)(1)(C) of the Federal Food, Drug, and Cosmetic Act, food contact substance notifications (FCNs) are effective only for the listed manufacturer and its customers. Other manufacturers must submit their own FCN for the same food contact substance and intended use.
Food Contact Substance: 2-Propenoic acid, 2-methyl-, methyl ester, polymer with 1,3-butadiene, diethenylbenzene, ethenylbenzene, and butyl 2-propenoate (CAS. Reg. No. 39373-52-9).

Intended Use: As articles or components of articles intended for repeat use in contact with food, except for use in contact with infant formula and human milk (see Limitations and Specifications).
Limitations/Specifications: The FCS is composed of a minimum of 60 weight percent of the polymer consisting of styrene and butadiene with the balance of the polymer consisting of one or more of the following monomers: divinylbenzene <3 wt.-%; butyl acrylate 0-5 wt.-%; and methyl methacrylate <25 wt.-%. The FCS may be used in contact with all food types under Conditions of Use B through H as described in Table 2. The finished food contact articles containing the FCS are not for use in contact with infant formula and human milk. Such uses were not included as part of the intended use of the substance in the FCN.
