According to Section 409(h)(1)(C) of the Federal Food, Drug, and Cosmetic Act, food contact substance notifications (FCNs) are effective only for the listed manufacturer and its customers. Other manufacturers must submit their own FCN for the same food contact substance and intended use.
Food Contact Substance: Poly(ethyl acrylate-co-glycidyl methacrylate-co-methacrylic acid-co-methyl methacrylate-co-styrene) (CAS Reg. No. 29437-40-9). REPLACES FCN 1213

Intended Use: As a polymer used in the manufacture of coatings, otherwise compliant with 21 CFR 175.300, on metal substrates for single use food-contact articles or on any substrate for repeated use food-contact articles, except for use in contact with infant formula and human milk (see Limitations/Specifications).
Limitations/Specifications: Coatings containing the FCS may contact Food Types I, II, IV-B, VI-A, VI-B, VI-C (up to 15 percent alcohol), VII-B, and VIII under Conditions of Use A through H; Food Type VI-C (up to 20 percent alcohol) under Conditions of Use C through G; and Food Type VI-C (up to 50 percent alcohol) under Conditions of Use E through G, as described in Tables 1 and 2 at 21 CFR 176.170. The FCS is not for use in contact with infant formula and human milk. Such uses were not included as part of the intended use of the substance in the FCN.
